1. Provider and Service
Leadora AG, a company incorporated under Swiss law, domiciled in Switzerland, provides an AI-powered lead management platform accessible at useleadora.com. The Service enables businesses to capture, manage, and respond to prospects with AI-assisted suggestions.
2. Description of Service
The Service includes AI-generated lead responses, prospect tracking, follow-up reminders, automated workflows, analytics, and related features. Users can register for free and access a 7-day free trial without providing a credit card. After this period, a paid subscription is required.
3. Pricing and Billing
Prices are displayed in Swiss Francs (CHF). Several subscription plans are available (monthly or annual). Each subscription includes a monthly credit allocation. Additional usage beyond the allocation incurs overage fees at rates specified in your plan. Billing is automatic upon each subscription renewal via Stripe. Unused credits expire at the end of each billing cycle and do not carry over.
4. Payment Terms
Payments are due upon activation of your paid subscription. Subscriptions renew automatically. You are responsible for providing valid payment information. If a payment fails, we will notify you and you have 7 days to update your payment details before the Service is suspended.
5. Waiver of Right of Withdrawal
In accordance with Article 40e of the Swiss Code of Obligations, the customer expressly waives the right of withdrawal for digital content services provided immediately upon subscription activation. Since Leadora provides immediate access to a digital service, the 14-day right of withdrawal does not apply. This waiver is explicitly accepted upon your registration.
6. No Refund Policy
Due to the immediate nature of the digital Service, no refunds are granted for paid subscriptions, except in cases of billing errors or failure to provide the Service by the Provider. Refund claims must be submitted within 30 days of payment. You may cancel your subscription at any time from your account settings, and your access will cease at the end of your current billing period. No partial refunds are issued for unused time within a billing period.
7. User Obligations
By using the Service, you agree to: provide accurate and up-to-date information, comply with all applicable laws, not use the Service for spam or unsolicited messages, not attempt unauthorized access, not use AI capabilities to generate harmful or illegal content, and maintain the confidentiality of your login credentials.
8. Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by Swiss law, the Provider shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed amounts paid to us in the 12 months preceding the claim.
9. Force Majeure
The Provider shall not be liable for any failure to perform due to force majeure events, including natural disasters, network outages, cyber attacks, strikes, or government restrictions.
10. Data Protection
The collection, use, and protection of your personal data are governed by our Privacy Policy. We comply with the Swiss Federal Act on Data Protection (DPA) and the GDPR for European users. Your data is stored securely and processed only to provide and improve the Service.
11. Intellectual Property
All content and functionality of the Service, including AI technology, are the property of the Provider or its licensors. You retain ownership of data you submit. You grant us a license to use it solely to provide and improve the Service.
12. Service Availability
Our servers may occasionally be unavailable for maintenance or technical reasons. We strive to minimize interruptions but cannot guarantee 100% availability. The Provider is not liable for service interruptions beyond our reasonable control.
13. Governing Law and Jurisdiction
These General Terms and Conditions of Sale are governed by the laws of Switzerland, specifically the Swiss Code of Obligations. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent Swiss courts.
14. Termination and Cancellation
You may cancel your subscription at any time from your account. Cancellation takes effect at the end of your current billing period. We may suspend or terminate your account for violations. After termination, your data is retained for 30 days, then permanently deleted unless legally required.
15. Amendments
We may modify these Terms from time to time. Material changes will be communicated by email or in-app notification. Continued use constitutes acceptance of the updated Terms.
